GigLane Vehicle Rental Agreement
Please review these terms carefully. You will sign a personalized copy of this agreement with your specific vehicle, rate, and start date after booking.
GigLane Vehicle Rental Agreement
This Vehicle Rental Agreement is entered into between Gilmore Lilly Rentals, LLC d/b/a GigLane ("Company"), Oakland, California, and the Renter.
1. Vehicle
The Company agrees to rent to Renter the vehicle selected at booking, beginning on the agreed start date.
2. Weekly Rate & Payment
Weekly rate as listed at booking, due every 7 days from the start date. A $50 late payment fee applies if payment is not received within 48 hours of its due date. Non-payment beyond 7 days may result in immediate vehicle repossession.
3. Mileage
Unlimited mileage for standard gig delivery use within California. Driving outside California requires prior written consent. Excessive wear from high mileage may be billed at Company's discretion upon return.
4. Damage Liability
Renter is responsible for all damage during the rental period, including collision, vandalism, theft, glass, and interior damage beyond normal wear. Damage exceeding $200 must be reported within 24 hours. Unreported damage discovered at return will be billed in full.
5. Late Return
Returns beyond 6 hours past the agreed return time incur a $75/day late fee. GigLane may repossess the vehicle without notice if not returned within 48 hours of the end date.
6. Prohibited Uses
Renter agrees NOT to use the Vehicle for:
- Rideshare services (Uber, Lyft) without written rideshare authorization
- Subletting or lending to any third party without written consent
- Any illegal purpose or activity
- Racing, off-road use, or activity that voids insurance coverage
- Transport of hazardous materials
- Driving outside California without prior written approval
7. Insurance
Renter must carry their own gig/commercial auto insurance and add the rented vehicle's VIN to their policy. Minimum coverage required: $50K/$100K bodily injury and $25K property damage. Renter must maintain a valid California driver's license. Any lapse in driving eligibility must be reported immediately and terminates this Agreement.
8. Pre-Rental Inspection
Renter must inspect the vehicle before accepting it. Pre-existing damage must be reported to GigLane within 2 hours of pickup (via text or email). Failure to report within this window means Renter accepts the vehicle in its present condition.
9. Accident & Incident Reporting
All accidents, thefts, vandalism, or mechanical failures must be reported to GigLane within 24 hours at (510) 225-8762. File a police report for any theft, vandalism, or accident involving another vehicle. Failure to report may void insurance coverage.
10. Maintenance
GigLane: Scheduled maintenance, major repairs, registration, roadside assistance coordination.
Renter: Daily fluid checks, tire pressure, reporting warning lights, keeping the vehicle reasonably clean. No unauthorized repairs or modifications.
11. Early Termination
Either party may terminate with 7 days written notice. Early termination without notice forfeits any prepaid fees. GigLane may terminate immediately for Agreement violations, non-payment, or prohibited use.
12. Vehicle Return
Vehicle must be returned in the same condition as received, with at least 1/4 tank of fuel. Renter is responsible for all toll charges, parking tickets, and traffic citations. Unpaid citations resulting in additional fees will be charged to Renter plus a $25 processing fee per citation.
13. Indemnification & Hold Harmless
Renter agrees to indemnify, defend, and hold harmless GigLane, its members, employees, and agents from any claims, damages, losses, and expenses arising from Renter's use of the Vehicle, including accidents caused by Renter, violations, or breach of this Agreement.
14. Right to Repossess
GigLane may repossess the Vehicle immediately without notice if: (a) payment is past due more than 7 days; (b) any Agreement provision is violated; (c) Renter's license is suspended/revoked; (d) Vehicle is used illegally; (e) Vehicle leaves California without authorization; or (f) Renter cannot be reached for 72+ consecutive hours. Repossession costs are Renter's responsibility.
15. Governing Law
This Agreement is governed by California law. Disputes shall be resolved in Alameda County, California.
